The bankruptcy code is a fundamental part of American law, authorized directly by the United States Constitution. For an individual or distressed business, it can be the difference between personal anguish, misery, or the failure of their business, and successfully overcoming the financial hurdles that stand in their way.

Areas of Practice

Individual chapter 7 cases are designed to permit debtors to liquidate non-exempt assets and achieve a fresh start. Business chapter 7 cases are used to liquidate and wind up businesses that are not able to be restructured and reorganized.
Chapter 11 bankruptcy is used primarily to restructure and reorganize a business debtor. Subchapter V of chapter 11 is particularly helpful for small businesses, and ordinarily much less expensive than a regular chapter 11 case.
Special provisions of the Bankruptcy Code may be used to help restructure family farm businesses, and help them to get out from under crushing debt.
The second most common bankruptcy for individuals, chapter 13, is designed to help individuals restructure their debts by agreeing to payment plans over three or five years.
